Terms and conditions
In short
- You can create a free account from age 16 (younger, with your parents' permission). To buy, you must be an adult or have their authorisation.
- Prices are in euros, including VAT where applicable. You pay through Stripe, and the course stays in your account with no time limit for as long as the Academy exists.
- If you want a course straight away, you agree to start now and lose your 14-day right of withdrawal for that course. Unredeemed gifts and unspent kuna packs can be returned within 14 days.
- Kunas are credits for AI features: they don't expire, they aren't money and they can't be transferred.
- When the Profesorica, Fabián and the Tribunal chat with you or correct you, that's artificial intelligence: it can get things wrong.
- What you write in your notebooks is yours. Public comments must follow the Community guidelines.
- None of this takes away the rights the law gives you as a consumer.
This summary helps you find your way around; it doesn't replace the full text.
1. Who we are and what these terms cover
These terms are the contract between you and Martín Silva Molina, who runs Croatiapp as a private individual (Ul. Ivana Rendića 28b, 10000 Zagreb, Hrvatska, OIB 42550330688), “Croatiapp”, “we”, “us”. Our full details are in the Legal notice.
They apply to all croatiapp.app websites and subdomains (the Academy, the courses, Mi cuenta, Mi cuaderno, the vježbenica, the dictionary, the blog, the portal and the rest) and to the Croatiapp apps for iOS: in these terms, “the Academy”.
To use the Academy you need to accept these terms. How we process personal data is explained separately in the Privacy policy, and cookies in the Cookie policy.
2. Words we use
- Course: a set of lessons (videos, illustrated plates, cards, exercises, exams and materials) sold as a single unit. It is digital content.
- Account: your personal access to the Academy, with your email or your Google or Apple account.
- Kunas: the Academy's virtual credits, which you spend on artificial intelligence features.
- Gift: a course that someone buys for another person, who receives it as a code to redeem.
- AI features: the Profesorica chatting with you, Fabián's sentence analysis, generated exercises and notebooks, the diagnosis and the exam assessment (see Artificial intelligence at Croatiapp).
- Your content: what you write or upload: notes, sticky notes, notebooks, routines, chats, comments.
- Consumer: a person who uses the Academy for purposes outside their trade, business or profession.
3. Your account
- Age: you can create an account from age 16. If you're younger, only with the permission and supervision of your parent or guardian, who accepts these terms on your behalf. The Academy isn't designed for children under 13.
- Purchases: to pay, you must be an adult under the law of your country or have the authorisation of your legal representative. If a minor made a purchase without authorisation, write to us and we'll sort it out.
- One person, one account: your account is personal. You can't share, sell or lend it.
- Your details: they must be true. Keep your password and access to your email safe; if you suspect someone has got into your account, let us know.
- Signing in: with email and password, with a code sent by email, or with Google or Apple. One session works across all of croatiapp.app.
4. What the Academy offers
The Academy teaches Croatian language and culture through video courses explained in Spanish or in English. Part of it is free (the first lesson of each course, the “How to use the Academy” course, the dictionary, the blog and the portal) and part is paid (full courses and kuna packs). What each course includes (lessons, length, language of instruction, level) is described on its page before you buy.
What you need to use it
- An internet connection. Videos play in the YouTube player, so YouTube must be available in your country and on your network.
- An up-to-date browser (Chrome, Safari, Firefox or Edge from the last two years) on a computer, tablet or phone, or the Croatiapp iOS app when it's available for that course.
- There are no offline downloads and no copy protection beyond signing in.
5. How buying works
- You choose the course, the gift or the kuna pack. Before paying, you see what's included, the total price including taxes and these terms.
- If it's a course for yourself, the course is sold with immediate access: to pay, you tick the box that asks for immediate access and acknowledges that you'll lose your right of withdrawal for that course. The box is never pre-ticked. If you'd like to make up your mind first, you can watch the free lessons before paying anything.
- You tap the payment button, which says clearly that the order involves an obligation to pay (“Pay”, “Buy now”), and pay on Stripe's secure page. Until then you can go back and correct any details.
- When Stripe confirms the payment, the contract is concluded and the course, gift or kunas appear in your account.
- We email you a confirmation with the purchase details, these terms and, where relevant, confirmation that you asked for immediate access. That email is your copy of the contract on a durable medium: keep it.
The contract can be concluded in Croatian, English or Spanish. We don't file a separate copy of the contract beyond your confirmation email and the purchase record in your account.
6. Prices, taxes and payment
- Prices are in euros (€) and are final: they include VAT (PDV) where it applies based on your country of residence. Outside the European Union, your country may charge its own taxes or fees (for example, on card purchases in a foreign currency), which are beyond our control.
- You pay by card or other methods offered by Stripe on the payment page. We never see or store your card details.
- When we announce a price reduction, we also show the lowest price from the previous 30 days, as the law requires.
- We don't personalise prices using automated decisions based on your profile.
- If a technical error makes a price obviously wrong (for example, €0.25 instead of €25), we'll tell you before charging you or refund your payment; we'll never charge you more than the price you saw.
- We email you the invoice or receipt.
7. Access to your course
When you buy a course, you get a personal, non-exclusive, non-transferable licence to watch it and use its materials to learn, with no time limit for as long as the Academy keeps running (see Licence).
Courses get better
We fix mistakes, add lessons and rework materials. We may modify a course for valid reasons (updating content, improving the teaching, technical or legal changes) at no cost to you. If a change significantly reduces your access or what you bought, we'll email you beforehand and you can terminate the contract within the following 30 days and get back a proportionate part of the price (art. 19 of Directive (EU) 2019/770).
If a course or the Academy closes
We'll give you at least 60 days' notice. If you bought the course less than 24 months earlier, we'll refund a proportionate part of the price for the time remaining until those 24 months are up and, in any case, the balance of paid kunas you haven't spent. You can download your data and your content before the closure.
8. Gifts and 3-for-2
- The person who buys the gift is the one who contracts with us and who has the consumer rights for that purchase.
- The recipient gets the gift by email as a code (
CRO-XXXX-XXXX) to redeem in their account. To send it, we need their name and email, which the buyer gives us: the gift email explains where we got their details. - Codes from a purchased gift don't expire. Promotional codes that we give away may have a deadline, shown next to the code.
- If the recipient already had that course, write to us: we'll swap it for another course at the same price or refund the buyer.
- A code can't be exchanged for money (except where the law requires it) and can only be redeemed once.
- Withdrawal: as long as the code hasn't been redeemed, the buyer can withdraw from the gift within 14 days of the purchase and get the money back (see Withdrawal).
- 3-for-2: you buy three courses to give as gifts and pay for two. If you withdraw from part of it, we recalculate: we refund what you paid minus the normal price of the courses that were redeemed.
- If a code gets lost or doesn't arrive, write to us and we'll send it again.
9. Kunas
Kunas are virtual credits you spend on the Academy's artificial intelligence features. They aren't the former Croatian currency and they aren't money: they only work inside Croatiapp.
- How you get them: we give you 5 when you create your account and 20 for each full course you own; you can also buy them in packs.
- What they're worth: each pack shows its price in euros before you pay (currently 20 kunas for €5, 50 for €10, 125 for €20 and 250 for €30), so one kuna is worth between €0.12 and €0.25 depending on the pack.
- What each feature costs: shown before you use it (currently one kuna per AI request and two to retake the final exam). If a feature's price changes, we'll tell you in advance.
- They don't expire as long as your account exists.
- They can't be transferred to another account, can't be exchanged for money and aren't electronic money.
- If an AI request fails because of a problem on our side, we give you the kunas back.
- Spending order: for refund purposes, gifted kunas count as spent first, then purchased ones.
- Withdrawal: you can return a pack within 14 days of buying it. We refund the value of the kunas from that pack you haven't spent.
- If you close your account, any remaining kunas are lost: before closing it, if you have unspent kunas bought in the last 14 days, ask for a refund. If we close the Academy or your account through no fault of yours, we refund the balance of paid kunas you haven't spent.
10. The right of withdrawal
As an EU consumer you have 14 days to withdraw from a distance purchase without giving a reason. For digital content, you lose that right when access begins with your express consent and your acknowledgement that you'll lose it. All the details, exceptions, the model form and the withdrawal button are in Withdrawal and complaints.
11. If something doesn't work: the legal guarantee
The digital content you bought must be as we described it and work as you can reasonably expect (Directive (EU) 2019/770 and the Croatian law that implements it). If a video won't load, a lesson is missing, an exercise doesn't work or something doesn't match what was offered, let us know: we'll fix it free of charge within a reasonable time. If we can't, you can ask for a proportionate price reduction or terminate the contract and get a refund within 14 days. These rights can't be excluded and don't depend on any commercial guarantee.
12. Artificial intelligence features
- When the Profesorica chats with you, Fabián analyses a sentence, the Tribunal assesses your exam or exercises and notebooks are generated, the answer comes from an artificial intelligence system, not a person. We say so in each feature.
- AI can get things wrong: check anything important against the course, the dictionary or a teacher. Don't use it for medical, legal or financial decisions, or to translate official documents.
- Generated answers are for your personal learning use.
- Don't use the AI to generate illegal content, to harass anyone, or to get around its limits or automate requests.
- To answer you, what you write and the lesson context are sent to AI providers: see the Privacy policy and Artificial intelligence at Croatiapp.
13. Exams, marks and diplomas
The Academy's marks, report cards, Tribunal exam records and diplomas are for guidance and personal use only. They aren't official qualifications of the Croatian education system or any other country, nor accredited certificates under the Common European Framework of Reference for Languages (CEFR). If you disagree with an assessment made by the AI, you can ask a person to review it by writing to hey@croatiapp.app.
14. Your content
- What you write (notes, sticky notes, notebooks, routines, chats with the AI) is yours and, unless you publish it, only you can see it.
- So that we can store it, show it to you and run the Academy, you give us a free, worldwide, non-exclusive licence, limited to that. It ends when you delete the content or your account (except for backups, which are deleted automatically on their cycle, and anything others have already quoted).
- What you publish for others (comments, reviews, portal listings) is shown to others with your name and profile photo. For that, the licence includes displaying it publicly and machine-translating it into the site's other languages.
- You're responsible for having the rights to what you publish and for making sure it isn't illegal.
15. What you can't do
- Share, sell or lend your account, or access to a course.
- Download, record, copy or redistribute the videos, illustrated plates, cards or any other Academy material.
- Use bots, scrapers or scripts to extract content, or use the content to train artificial intelligence models.
- Try to access parts of the system that aren't meant for you, probe for vulnerabilities without permission, or reverse-engineer it.
- Cheat with gifts, codes, kunas or payments (for example, chargebacks on purchases you did receive).
- Publish illegal content or content that breaks the Community guidelines, impersonate someone else or harass anyone.
If you find a vulnerability, please tell us at legal@croatiapp.app before making it public: we'll be grateful.
16. Moderation and restrictions
Under art. 14 of Regulation (EU) 2022/2065 (the Digital Services Act), here's how we moderate content that users publish:
- What isn't allowed: whatever the Community guidelines say.
- How we detect it: through notices from users (the “Report” button and the form) and review by a person. We don't use automated systems that remove content; reviews, events and listings on the portal are published only after a person has reviewed them.
- What we can do: hide or remove content, limit its visibility, suspend your ability to post or, in serious or repeated cases, suspend or close the account.
- We tell you why: if we take action on your content or your account, we send you a statement of reasons (what we did, why, which law or term we relied on and how to challenge it), unless the law doesn't allow it.
- How to challenge it: reply to that email or write to legal@croatiapp.app. A person reviews it and we'll get back to you. You can also go to court or to the competent authority.
17. Intellectual property and licence
All the Academy's content (videos, voices, scripts, illustrated plates, cards, comics, exercises, texts, characters, design and software) belongs to us or is used under licence. We give you a personal, non-exclusive, non-transferable, non-sublicensable licence, revocable only for serious breach, to view and use it for learning, on your devices. You can print or export to PDF your own notebooks and routines for personal use. All other rights are reserved.
18. Availability
We do what we reasonably can to keep the Academy running at all times, but there may be outages for maintenance, because of provider failures (hosting, YouTube, payments) or for reasons beyond our control. If an outage stops you using what you bought for a significant time, write to us.
19. Liability
- We are liable without limit for damage caused intentionally or through gross negligence, for death or personal injury, and in every case where the law doesn't allow liability to be limited.
- For slight negligence, we are liable only if we breach an essential obligation of the contract, and only up to the foreseeable damage typical of this kind of contract.
- We aren't liable for the content of linked third-party websites or for how you use AI answers outside the Academy.
- Nothing in these terms limits the rights the law gives you as a consumer, including the legal guarantee of conformity.
20. Closing your account
- You can do it whenever you like: from your account (Settings → Delete account) or by writing to legal@croatiapp.app. Closing your account means losing access to the courses you bought and your kunas, so we'll ask you to confirm first. What happens to your data: Privacy policy.
- We can do it only for a serious or repeated breach of these terms (fraud, a shared account, illegal content), on the order of an authority or where the law requires it. We'll warn you first and explain why, unless it's urgent or the law prohibits it. If it's not your fault, we'll refund a proportionate part of what you paid and the balance of purchased kunas you haven't spent.
21. Changes to these terms
We may update these terms because of legal, technical or service changes. If a change is significant, we'll email you at least 30 days in advance. Changes never make what you've already bought worse. If you don't agree, you can close your account before they take effect (with any refund due under Closing your account). All previous versions are listed at the bottom of this document.
22. Governing law and courts
- These terms are governed by the law of the Republic of Croatia. If you're a consumer living in another country, you're also protected by the mandatory provisions of the law of your country: this choice of law doesn't take that protection away (art. 6 of Regulation (EC) 593/2008, Rome I).
- If you're a consumer living in the European Union, you can sue us in Croatia or in the courts where you live; we can only sue you in the courts where you live (arts. 17 to 19 of Regulation (EU) 1215/2012).
- Before going to court, tell us about the problem: an email almost always sorts it out. The complaint and alternative dispute resolution options are in Withdrawal and complaints.
23. Languages of this contract
These terms are available in Croatian, English and Spanish, and all three versions are equally valid. If there's any difference between them, the version in the language you contracted in prevails; if you live in Croatia, the Croatian version prevails.
24. Final provisions
- If any clause is invalid, the rest remains in force.
- If we don't enforce a right at some point, that doesn't mean we waive it.
- We may transfer this contract to whoever continues the Academy (for example, when Croatiapp becomes a registered sole trader business or a company), after telling you and without you losing any rights. You can't transfer your account.
- We aren't liable for failures caused by force majeure (disasters, widespread internet or power outages, decisions by authorities) for as long as they last.
25. Contact
Any questions about these terms: legal@croatiapp.app, our contact page or by post to Ul. Ivana Rendića 28b, 10000 Zagreb, Hrvatska.
